General terms and conditions of business

for the MIJOSURF online shop http://www.mijosurf.com and https://www.instagram.com/mijosurf/

§1 Scope
(1) These terms and conditions apply to all contracts for goods and services between the operator of the MIJOSURF online shop, namely Joscha Arndt, Marienberg 7, D-41844 Wegberg (hereinafter referred to as "Mijosurf"), and you as a customer.
(2) Contracts with Mijosurf can currently only be concluded in German.
(3) The General Terms and Conditions shall apply in the version valid at the time of conclusion of the contract.


§2 Conclusion of Contract and Contracting Parties
(1) The offers in the Mijosurf online shop constitute a non-binding invitation to you to order goods. By placing your order, you submit a binding offer to conclude a purchase agreement. The agreement is concluded as soon as Mijosurf accepts your order by sending an order confirmation via email.

§3 Cancellation Policy
(You can print out this cancellation policy and add it to your order documents. It is also included in paper form with your delivery.)

(1) You have the right to withdraw from this contract within 14 days without giving any reason.
(2) The cancellation period is 14 days from the day on which you received the goods.
(3) Cancellations can be submitted via our automated returns portal . This allows for quick and smooth processing.

(4) To meet the withdrawal deadline, it is sufficient for you to send your notification of exercising your right of withdrawal before the withdrawal period has expired.

Consequences of revocation
(5) In the event of a valid cancellation, we will reimburse all payments received from you (less any return shipping costs in accordance with Section 13 of these Terms and Conditions) no later than 14 days from the day on which we receive notification of your cancellation.
(6) We will use the same payment method for the refund that you used for the original transaction.


§4 Prices and shipping costs
(1) All prices in the Mijosurf online shop include the statutory value added tax of currently 19%.
(2) Shipping within Germany is free of charge.
(3) Shipping costs within Europe (excluding Germany):
Standard International: EUR 15.00
Delivery time: 2 to 8 working days
(4) Premium shipping via FedEx, TNT or UPS is available upon request and at an additional cost.


§5 Payment Terms
(1) You can make payments using the following payment methods: PayPal, credit card, Klarna or instant bank transfer (direct bank transfer).
(2) Mijosurf reserves the right to determine the payment methods available at any given time.


§6 Delivery Terms
(1) Delivery will be made to the delivery address you have provided.
(2) Goods in stock will be dispatched within 2 working days.
(3) Delivery times: within Germany 1–2 working days, within the EU up to 8 working days.
(4) You will be informed immediately of any delays.


§7 Warranty
The statutory warranty rights apply. For fashion items that may show signs of wear and tear due to their nature, the usual industry regulations apply (repair, replacement or price reduction).


§8 Retention of title, set-off, right of retention
(1) The goods remain the property of Mijosurf until full payment has been received.
(2) Set-off or retention is only permitted in the case of recognized or legally established claims.


§9 Data Protection
Protecting your personal data is important to us. You can find details about data processing in our privacy policy on the website.


§10 Product descriptions and images
Our product images and descriptions are created with the utmost care. Minor variations in color, shape, or texture do not constitute a defect.


§11 Sizes and Fits
Please refer to the size charts and fit information provided on the product pages to avoid unnecessary returns.


§12 Packaging and Shipping
We carefully package our goods to prevent damage during transport. Special requirements are taken into account.


§13 Returns and Returns
(1) Returns are generally made via our automated returns portal to ensure fast and smooth processing.

(2) If you use our return label, we will deduct a flat fee of EUR 5.00 from the refund.
(3) Alternatively, you can return the goods at your own expense . In this case, the flat fee does not apply.
(4) Return postage costs will not be refunded, as we want to make our sales prices particularly attractive for you.
(5) Refunds will be issued within 14 days of receipt and inspection of the returned goods.

§15 Origin of the products
(1) Hats and caps: Made in China.
(2) T-shirts and hoodies: Made in China and printed in Germany.
(3) Poster: Produced in a local printing shop in Germany.
(4) Picture frames: Made in Italy.
